 Denise Keller, a mother of two, is suing Chuck E. Cheese on the grounds that its games constitute illegal gambling. According the lawsuit, she noticed that the pizza outlets were replacing traditional skill games like skee-ball and whack-a-mole with games that resembled the kiddie versions of slot machines the lawsuit states, "many games found at Chuck E. Cheeses' restaurants are illegal gambling devices that require little or no skill and are predominantly games of chance, much like a roulette wheel. With rare exception (none of which exist here), gambling is illegal in California." Keller is seeking "restitution from CEC and an injunction prohibiting it from offering these devices to its customers in the future."
Chuck E. Cheese has long had the reputation for being "a safe, wholesome environment" where "a kid can be a kid." The chain is a hot spot for children's birthday parties but according to Keller's attorney Eric Benink of Krause Kalfayan Benik & Slavens, the new games take a lot of the fun out of the arcade. "There was no fun involved in the game other than an opportunity to win a prize," Benink said. "It's just pure random luck in terms of spinning out a result. That, we believe, is a slot machine as California penal code spells out."
The suit appears to be just part of a growing opposition to arcade games aimed at children. Some argue that these types of games lead to problem gambling in adults and believe it or not this is not the first suit of its kind. Parents have sued the chain already in several southern states and won. This is the first time however, that an individual customer has sued Chuck E. Cheese for offering gambling to children and he says that the stakes are high. "Early exposure to gambling increases one's chances of being a gambling addict later in life," Benink said.
Chuck E. Cheese chose not to comment on the matter. A spokesperson for the chain stated simply, "Our company policy is that we do not comment on pending litigation."
