Foxwoods is fighting to keep their license to build a casino in South Philadelphia. Philadelphia Entertainment & Development Partners (PEDP), a company partnered with the casino, filed an appeal to the Commonwealth Court on Monday seeking to reverse the revocation of the $50 million license. In the petition, PEDP stated that the Pennsylvania's Gaming Control Board denied Foxwoods the chance to adequately argue their case when it refused to hold a full hearing and instead issued a summary judgment on December 16th. PEDP called that decision "an excessively draconian sanction" and accuse the board of making "a legally flawed" decision "without conducting an evidentiary hearing to resolve numerous disputed issues of material fact." They add that they spent more than four years and $160 million to develop the casino project and that they were doing their best considering the circumstances.
The Foxwoods partners were one of only two groups to win the coveted license to build a casino in Philadelphia. The other recipient, SugarHouse Casino, opened the city's first casino in September and after repeated delays the gaming board determined that Foxwoods was no longer financially suitable to hold a license citing their inability to meet a May 29, 2011, deadline to open. PEDP presented proof that they had the financial backing to complete the project in their appeal. The Gaming Control Board will now have until May 11th to make a decision on the matter.
