The battle over gambling domain names rages on in Kentucky. The Commonwealth of Kentucky recently decided to take on domain name owners in easier to manage smaller groups hoping that they can coerce the domain name owners with amnesty for turning each other in. Thankfully, iMEGA has once again come to the rescue of domain name owners.
The online casino group filed a motion to intervene on behalf of the domain name holders on December 6th. They made a case for intervention on three basic counts. First, they point out that the case management order requested for by the Commonwealth of Kentucky leads to a process that is not permitted by law and not in accordance with the order of the Kentucky Supreme Court, second they said that the Commonwealth's action is without basis in Kentucky law and that the Court is without subject matter jurisdiction to proceed, and finally they said they would like to intervene "for the general purpose of representing its members' interests against all claims in this action."
The counsel for iMEGA also clarified that it has met all the conditions set by the Kentucky Supreme Court for establishing its standing to represent the domain name owners. Earlier this year, the Supreme Court asked that iMEGA produce at least one domain name owner, which they did, so their standing should not be in question.
Judge Thomas Wingate passed an order granting the motion on the basis of iMEGA's filings. The next hearing has been scheduled for December 13th.
